Early this spring I bought a used boat and MB 35 (stock) with 1.5 hours on it. The dealer gave me a 2 year dealer warranty on the motor and 1 year on the frame. I did the break in oil change at 20 hours like he told me. The motor now has 39 hours on it.

Friday night I was going down the river with two other guys when the motor blew a hole out both sides. I couldn’t have been turning more than 3900 RPMs. I brought the motor to the dealer today and dropped it off. After having a conversation with the owner this evening, I feel like he may be trying to get out of his warranty.

He said he can’t tell me if the motor will be covered under warranty until they figure out what went wrong. He proceeded to tell me that it looks like the motor was run rough. I asked him how he figures that. He referenced the mud on the motor and the paint that is warn on the skeg (like every other skeg I have seen). The prop is in perfect shape. The mud on the motor is from my dog climbing onto the hunt deck from the silty water and shaking.

He went on to say if it was stored outside that water could have got into the crank case through the muffler. First of all I use a 100 MPH cover on the motor. Number 2, every motor on his lot is stored outdoors, uncovered. Over the weekend the motor was uncovered in the rain. I didn’t think anything of it because it was blown. During the rain over the week end water could have got in through the gaping hole in the side of the motor. I am worried he will try to say water did it.

He said maybe I hit something and that caused it.

The last thing that he said was I could have over revved the engine. I told him that it has a governor to prevent that, and how can you look inside the engine and determine I was over revving the engine.

The dealer said that it would be a “he said, she said, kind of thing”.

I feel like I should probably be present when they open it up. Seems like they can make up any excuse. All he has to say is the case was full of water.

Any suggestion what I should do?

Be present when he looks into the motor, document what he tells you and what excuses he comes up with, document your work on the motor for oil changes and whatnot, and let him know that if he doesn't make it right, you will take him to civil court for the costs.

Based on the way he’s acting, I’d take detailed notes of every conversation you’re having and get any and all documentation of your warranty together. I’ve avoided having to go to court by making sure who I was dealing with knew I had documented everything and was familiar with the details. Folks tend to act right if they know you’re detailed and well-prepared for their BS.

I am going to be there when they look in. Tomorrow I am going back to get pics of it as it is because he is trying to say it looks rough.

There isn't a mark on the thing. Just mud from my dog shaking river bottom all over it.

This sounds like exactly what I said to duckaholic.

A shady owner will recognize it will cost you more to litigate them not respecting the warranty than it would for you to just replace the power head. If they don’t care about reputation (which many accept they don’t have repeat customers so they don’t care) then they have no reason to honor the warranty. The cost benefit analysis is not there for you to take them to court, so if he is shady, nothing you can do. Sorry dude.

Pics and Video.

Try to get him on record saying whatever he says. Make sure he knows you are videoing and taping him.

Video motor and anything they say.

Record any phone conversation and save every email or text.

Try to get him to say the crap he blew up your ass again on record.

How did he give you warranty? What exactly does it say? In writing?

Anything he tries to float by you at this point is bullshit. (assuming you are being 100% honest)

Sounds like there was something bad in internals to begin with. Unfortunately, sometimes it is hard to tell exactly what caused the failure when it blows up that bad, but can probably get a good idea...

Did you park it outside? Are you kidding me? That alone earns him a kick in the cooter.

briggs has a 3 year warranty lol. call for a preauthorization on that issue and Briggs will make the call. id hope the dealer has a good rep with Briggs.

Warranty is warranty until it’s twisted around

I am starting to hear more and more that some people have taken water in the cylinders on their Prodrive’s from trailering it in the rain. That will cause rust; pitting and scarring. It happened to me and it happened to someone else under warranty and Briggs didn’t cover it. Said it was not their responsibility to protect the engine in that regard and was user neglect

They were supposed to tear the motor down this week. I asked the owner via email if I could be there while they are tearing it apart. He never answered. So I called and spoke with the service manager who said he would call to let me know when they were doing it. I still have received no call.

Okay... I just spoke with the mechanic that will be working on the motor. He said he is going to take it apart tomorrow and that he has no problem with me being there. He went on to say that he is sure that it will be covered under warranty, and that he is not going to be able to determine a cause by looking in it. It has been sitting in the rain with a hole so water will be in there.

I am starting to feel better about it so far.

Maybe I will not have to punch the owner in the COOTER.

When this crap is all done I will list their name if I feel slighted at all. If I list their name now I would likely just piss them off and cause myself more problems then I have already.

Because most of you guys are down south it is not likely you will ever deal with this Michigan dealer.

Last Friday I stood hung out with the mechanic as he took the motor apart.

Everything inside was in good shape except the rod in the pic. Even though the owner was sure they would find something pointing to me...they did not.

Pull the rod cap and post pics. I want to see if it ran hot/Low on oil. Before they just put a rod on for you.... have the crank miced on the #1 and #2 journal

Pay for a block? Or are you referring to a complete motor?

Imo briggs is going to say that it being on a mudmotor and out off warranty they are off the hook.

Dmax, the whole being on a mudmotor is irrelevant to Briggs. They built a marine version specifically to support the mudmotor market, so them not footing the bill would have nothing to do with its use. I don't see them paying for an out of warranty breakage even though it came apart on the inside of a stock engine, but the dealer is going to resolve that if Briggs won't.


Maxxis, Why not get the 40 for the difference in what the dealer is going to pay and the price of the 40? Then he'd get some power upgrade without "out of pocketing" the whole price of an engine. His other option is mods, but then the warranty isnt 3 years and he's proven that him touching a stock engine doesnt exactly end well. lol

Here is a rough estimate for comparison.
$1300 shortblock
$450-500 labor
$100 fluids filters
Depending on what the shop does.... that is between you and the shop
$1900 for a stock briggs

New 40 efi $4200+$100 shipping approx.
$350 ish to remove/ replace engine and rewire it.
The wiring has to make a few pin changes to work with the EFI harness/plug.
$4650 for a 40 installed 3 yr warranty

So this is the best way to put it.

Mods on your 35 will be roughly
Heads $650-$750 (depenfing on options) Labor in short block swap.
Cam $350+175 labor to pull apart short block and swap it)
$850 carb kit $100 labor to swap and tune the carb after build
Exhaust $620


Roughly $2900 in addition to your short block swap.. for mods that will make WAY more power than a stock 40

The dealer got off the hook. Even though the motor was out of warranty Briggs is sending a new block.

When they put everything back together I am having worked heads put on as well as a Mikuni.
