Son was in an accident where other driver was completely at fault and cited. Our car was totaled. Other driver’s insurance is lowballing the value of the vehicle. Damn shame that all we are entitled to is the “value of the vehicle at the time of the accident” and have to go through hell just trying to get that!

Now I know why there are so many frivolous lawsuits after an accident.

Or....maybe that’s why insurance companies don’t want to pay out?

I don’t know....either way...you are required to pay them all your life and heaven forbid if they ever need to pay you for a claim.

Rant over.....I’m to the point where I am going to go against my morals and hire a lawyer....even if I lose money on the whole deal...simply on principle, now. Everything we had to pay out for a replacement vehicle above the value....yeah....simply not right for somebody else’s negligence.

Have you talked with your insurance company? Can you provide comps that are for sale locally?

Don’t sign anything, make sure you have a copy of the police report as well as body camera footage, and contact a good lawyer. Sounds like you have a decent case

None of same year/make/model/trim locally. Found several on auto trader and had the average of those against KBB avg value is what I demanded....the avg of ones for sale was higher than the KBB.

I’m going to call an attorney and go after the differences....even if I lose out in the end....I’m not going to roll over. As I see it, Nationwide is paying for storage at the salvage yard until I sign over the title....so, they gonna pay one way or the other. LOL

I have had good luck in the past with providing comps, but I would also lean on your agent and get your insurance company involved in the fight if you haven't done that yet. If the other company is low balling you and you can show it on paper, your company should back you. May even let you file an uninsured/underinsured claim, pay you the diff, and then continue to go after the other company themselves.

They owe you replacement value, not blue book. Those are not the same thing and sometimes are thousands of dollars apart.


Had a buddy at work just go through this on an older suburban. KBB value was only like 3 grand, but his was clean as a whistle and crazy low miles and they were offering him right at like 3100. He found a handful of local comps with way more miles in the 5-6 range at local dealers and was able to finally get them up to just under 6k after a month or so of back and fourth. I would wait on hiring a lawyer until you have completely exhausted all other possible options. They will generally make things much worse.

I used to work in insurance. Insurance companies will do anything they can to wiggle out of settling a claim, that's how they make money. Don't sign anything and review your policy for language that could get you more indemnity. Request a copy of the insurance policy for the other party involved. Use the definitions pages the language is tricky for a reason. Try to rattle the adjusters cage. Watch out for Replacement Costs vs Actual Cash Value that's often where they'll get you.

That is why I use Farm Bureau. When my vehicle was wrecked and it wasn’t my fault. Farm Bureau paid for the extensive repairs and rental cost that week and then went and get their money back from the other insurance. Some insurance companies are absolute frauds. Farm Bureau is not one of them.
I put on average 35,000 to 38,000 miles a year on my vehicle. I need to stick with a good company.
When my Gatortail was totaled, they paid me out rather quickly. Although it wasn’t exactly what I wanted, it was at least close enough to not get mad. They paid it and then went to the other insurance to get their money back.
