Post Anyone had to take a dog breeder to small claims court?
Here's the story, I bought a black lab male puppy from a breeder who specializes in silver Labradors. I know, I know, it was a Christmas present for my wife. After 5 months and thinking I just had a short legged dog I began to do some research and came up with a conclusion that the dog has SD2 (Skeletal Dysplasia 2), which is a dwarfism in Labrador Retrievers that occurs as a genetic condition from a recessive gene, so both parents have it. I took the dog to the local vet and she confirmed that the dog indeed did have SD2 by her professional opinion. I called and let the breeder know and she wanted to know what I would like to do about it. The breeder offered another dog, which I do not want because of my current house. I informed the breeder that I would like a full refund, she said she would get back to me. Days go buy and no word so I called and got the offer to refund the extra $100 that I paid for full registration, I informed the breeder that would not work. In the contract it states that if the dog is guaranteed not to develop hip dysplasia within 2 years. In the next sentence it says if dysplasia occurs (doesn't say hip in the second sentence) that I am due a full refund, so that may be splitting hairs in court. So here's the question have any of you taken a breeder to small claims court and what was the outcome? The thing that bugs me the most is the drive and love for the water that this pup has is excellent. So basically as of right now I'm stuck with an overgrown weiner dog.

Give the dog a chance. He may be the best retriever in the world, just may take a little longer on every retrieve.

I have to agree with dean about giving the dog a chance. That being said I would still pursue some sort of refund as the dog has problems.

A letter from a law office like Dewey, Cheatum, and Howe should compel the breeder to give you a full refund. But don't be sad when the breeder takes the dog back and euthanizes it.

I'm not going to kill the dog, or let the breeder take him back to kill him. He's already part of the family of even if he is just a sawed off lap dog. The medicine I deserve? Don't quite follow you there, this can happen to any lab not just silver labs. It's actually tested for by reputable breeders in the UK, but not in the US.

Definitely let the dog live, but if court doesn't work. The word of mouth and internet can really hurt a breeder. I would spread your experience with others.

If you want to give the dog up, I know this really nice Chinese family that own a restaurant, they are always getting dogs. Wait, they always get dogs, but I never see the dogs they already had. Oh well, maybe they give them to others. :o

Pretty common response for a breeder. Usually they will offer a dog and demand proof that the current dog is euthanized or neutered or possibly a refund and want the dog back. Don't think I've ever heard of a breeder give a refund and allow an intact dog to be kept.

I planned on having him cut anyway once we found out the issue. I don't want to pass the gene on even though the breeder will continue to. I'll just keep the little guy if they demand for him to be euthanized for a refund.

VooDoo on that subject my Dad and his whole station ate dog tamales for a long time. Until they made a fire at the tamale ladies house. He did say the tamales were good though.

Pintail the condition actually won't affect him in any other than being short, which is a good thing. I don't have any doubt he could do the work, if he could see over the grass haha. I had him fetching ducks in the yard at 8 weeks.

Oh you can call the little dude syndrome, so evertime he jumps up you can yell "Down syndrome down!"

Just look at all the tucker you won't have to feed him or dog crap on your lawn, the size won't matter at all. I run a springer spaniel and they are better size in blinds and work just as hard as a Lab

Can I ask which parent body is your dog reg with . ( UKC or AKC ) Did this breeder promote the color silver , and never did say choc , and does she run a kennel . Don't be surprised that more health issues don't come up down the road . Next time you look for a lab , do your homework , contact a retriever club , they'll point you in the right direction .

Stay away from anyone that is raising designer dogs! They are not in it for the breed just the money. Most of the problems we see in dogs are from these type of breeders.

Thanks for saying no matter what the dog is going to live. I was thinking this thread was going to go sour. I would try and hunt him. He is a handsome boy. If things don't go right I am sure you can find a good home for him. He would fit perfectly in a field blind

He is registered through the AKC, contacted them they said get in contact with the parent club. The breeder promotes silver labs as the sire is. I am going to try him out this next season, I believe he has the drive for it, I'm just not going to waste any money on training.

I figured that dysplasia was the same kind as hip and elbow, and would be a torturous life for the dog. Better to hear that what he has won't cause long term problems.

The UKC has moved forward to denied any register lab that has the word silver in it's name , or the color of hair is silver . It will not knowingly do so .
The AKC has been letting them register as a chocolate , but are disqualify from conformation events . The judges are suppose to report said dog to the parent club .
Here's the thing , the parent body's are sitting on the fence and not enforcing their rules , my thinking is their making a crap load up money off those trash litters .
The other thing here , if their not allowed to compete in conformation , because they don't want the defective gene in the high bred lads , but it's ok to let them run in performance events .
Now we have these bullshit kennels promoting champion hunt test / hunting dogs using the logo's of parent body's as a tool . The funny thing is , the dog's only have a SHR title , or JH . This isn't a high title at all , and mainly for newbies to get them hooked . Fact of matter , silvers as of today , don't live a very long life , have many health issues , and most of the time go blinding , or have bad eye sight . Anyone wanting a hunting dog , run like hell from the silver . You are better off getting a mix retriever breed , the odds are better of getting a hunting dog than a silver .
Glad you're giving the pup a chance , and you're doing the right thing by getting him fixed and not passing a problem further into the problem .
