That material would be public property as well. One could argue that you were the harasser getting in a blind you didn't build and preventing the builder from legally harvesting game. The Hunter could successfully argue he's just moving the blind he personally built. I'm not arguing whether or not either party is correct, and Guidry probably deserves to get his ass kicked, but his hunter harassment claim is at best a stretch and twist of the law...then again, that's what he's good at.

No, you posted MN law and how ya'll do it UP THERE. The event happened in LA, I first posted about GA law and my experiences with said law(of which you have NONE!!!) Nobody gives a damn about MN law in GA or LA for that matter.

These are the LA statutes. Nothing stated about removing blinds and such. Just mentions interfering with taking. If it's before shooting hours you definitely not interfering with TAKING an animal.

#1 touches on it with the process of taking game as in setting up on a spot setting decoys ect it's all part of the process. You can't attempt To take game without getting to a spot and setting up its a big part of the process

I would say removing a blind while someone is hunting it would be disturbing a person in the process to dissuade them from taking game from that location

He is not letting the actual process of the hunter make an undisturbed shot at a bird. The process is to call, aim, and shoot the bird. That's what actively taking means. If the taking is not actually happening, before shooting hours, it is not being interfered with.

Puddler is correct. The statute is broad enough so as to cover ever conceivable event in the process to taking game. Another example of a broad wildlife statute is the prohibiting hunting over a baited field or waterbody. One does not even have to know it's baited to be charged with this offense.

Just saying something like "get the hell out of my blind" would get you arrested on a WMA.

Leave the interpretation of the laws to experts like me. I quarantee what was done to us was a clear violation.

I'd rather not leave interpretation to you. I'd rather represent myself. Being a broad statute as you say would make it easier to keep you from being charged with the offense.

BTW, the baiting statue is not broad by any means. If people would take time to read them, they only take the comprehension skills of a 5th grader.

Technically by getting in the blind he set up if anything you were interfering with his hunt. So either way you wouldn't have a case because you were both in the wrong. I'd have taken the brush and there isn't a thing you can do about it, unless you have proof of the person in question you have no case. And I doubt you would want to get into a fight with someone over the water in the middle of the woods trying to take a picture of them. Either way you wouldn't have gotten any sort of hunter harassment charges with this one and the judge would've laughed you out of the court room trying to bring that shit in there. Especially considering you are an "expert."

It all depends on the judge but its taken very serious and wardens will right ticket for trying to kick you out of a blind or spot up here. One call and the warden usually shows up pretty quick to investigate. Either way law says no permanent blinds are aloud in that area on public land so one should not be all butt hurt when someone is in their illegal blind when they show up later. first come first serve.

We also got these moonbat tree huggers that like to drive around and follow bear hunters running there dogs. following people setting wolf traps setting up cameras over looking their sets. People walking through during deer season trying to scare away deer or worse wearing animal costumes in some cases.
