Calm down there home boy I was jokin obviously being sarcastic. Look up any of the laws the fella "spouted" off. And then tell me they were bs. You are right the officer was doing his job but had no right to take his firearm. And no right to get his I'd. You can't argue those facts so stop. The point of all of this is to show you how the views of this country are so distorted. They even have some avid gun owners thinking that open carriers are bad people. mainstream media has made people loose sight of what this country was founded upon. I suggest to a couple of you to step back and evaluate where you stand. To honestly say that this guy is subjecting himself to being detained by police is bullshit. He's exerciseing his forefather given rights, his god given right( bc this country was founded one nation under god).

To see someone walking down the street with a gun and automatically assume he is going to kill someone and call the cops on him is distorted. That's like seeing a couple men on the corner talking and shake hands and assuming a drug deal is taking place. It's stupid.

Actually the cop has no right. He must have reasonable suspicion. He cannot detain a person on the basis of open carry on public property as he did.

Are you? Did you look them up? I did speak to a friend that is a lawyer as far as he's concerned if there has been no Crime committed or has no reasonable suspicion he isn't not within the law to detain me.

Maybe and I don't need to he didn't actually quote any laws but referenced court cases/supreme court rulings

You are correct they are rulings that are interpretations of the LAW.

I am pro carry and a LEO for 23 years and counting. I like most 5-0 on here have dealt with many a open carry call/complaint. Most recent a guy with a handgun tucked into the back of his sweat pants while shopping at walmart at 3 am. I went there and spoke to the guy about this display without detaining him or asking him for his handgun permit. He admitted it was a little tacky and would tidy up his approach. I myself have no problems with someone visibly carrying a handgun in public.
My concern is that most people have no idea of the handgun carry law and most dont care. I would like for those kind of people to stay neutral in our battle over gun control. I want people that have no care to have no say. However by a sloppy incident could cause these 'don't care' people to care and take up with the wrong side.

I guess how I feel, is the cop where ever it may be shouldn't take the firearm, or and id. Ask how they are doing and why they are asking. Let them know they are within their rights to carry. Just getting complaints.(bc your carrying a firearm) get a description of the person to put in the report and move on. If something happens they know exactly what the fella looks like. That's all it should take.

I hope this^ is a joke! If something happens you have a description of the guy and that should be enough? Are you serious? Plus how unsafe is it for a cop to go to a complaint of a gun with a gun and not take the and make it safe while they're talking. You know you're not gonna shoot the cop but he doesn't know that. Theirs plenty of those laws/court rulings that support officer safety

officer safety is the #1 priority, and i'll be damned if i'm gonna worry about what people perceive as a cop infringing on someones god given constitutional rights. cops don't just show up places like it's trick or treating and shake you down for your cc permit, they got dispatched there because obviously it created enough concern for a citizen to call in a complaint. if you don't wanna be disarmed during the contact then don't be a jackass and refuse to provide id and start spewing off about how it's your constitutional right. it's the cops god given right to make sure they go home safe to their family at the end of the shift, the constitution does not trump that. cops don't play fair, and if it means you have to be disarmed to maintain order and control of the situation, then that is what is gonna happen. if you have a cc permit then all you simply have to say is that you have a permit and you're carrying, most cops will say thank you for telling them that and tell you to make sure you don't reach for it. this call could've turned to shit in a hurry, and these blowhard gun rights guys don't see that. i'm all for guns and people carrying them responsibly, but i think a lot of guys seem to forget the reason you're carrying it is for a deadly force scenario, nothing more, nothing less.

Post Re: Cop gets owned....
ok nasty...i spent a little time researching last night. not a great deal as my phone was about to die. one thing i did find per maine carry law is the carry holder must show id upon request. if the carry holder refuses the officer can file a charge(excuse me as i cant remember the 100% wording). the carry holder can go show court that he/she held a valid carry permit during the time of stop and everything is ship shape. SO...if the cop in the video was a little sharper and less timid he could have gotten his way. the civilian was out of line to give the cop such a hard time. if you dont have anything to hide then dont hide it. im sure the guy had his carry permit, but he should have been more cooperative. as you said nasty if i were the cop i would have started the convo very relaxed and informal. but whos to say that the cop didnt, im sure he didnt start the video as the cop was walking up per the setting and discussion.

im going to search maine law and see if the cop for sure had the right to disarm a civilian in that sole state. i know they do in TN but were talking about maine.

also like netman said, sloppy carry is a bad move. there was a child shot within past year at a grocery store (20 mins from my house) from an older man that had his pistol in his shirt pocket. he bent over to pick up change he dropped and gun fell out and shot to small boy i think in his leg? it was a non critical wound but none the less very preventable. open carry with a single stage holster is a bad move. bad guy walks up behind you and your disarmed before you know it. and theres not a lot you can do about it other than keep walking.

If its for his safety what's for my safety, are you aware of police brutality? Or this police officer in california that went on a killing spree. It goes both ways. My point is the encounter should be respectful of both the cop and carrier. The carrier has done nothing wrong. The person who called just doesn't know the law. The person should be enlightened. As well as the carrier should speak to the cop in a respectful way, and vica versa.

Most of the guys i hunt with are cops, i agree with goosie 100%. Officer safety is definately number one on their list of priorities. These guys do a job that many don't appreciate and even fewer want to do. I used to joke with one of my buddies when i worked in retail: "I'm talking to a customer and they are always right, you on the other hand are dealing with someone because they most likely did something wrong." Police officers aren't out to get you, and they have to assume the worst when they get a call: for their safety, and the safety of all others around. I agree that in the video the officer COULD have handled the situation differently; however the guy who was carrying definitely SHOULD have conducted himself very differently. The way i see it, an officer approaching someone on foot who is carrying should disarm the subject for their safety. Why? Because when you reach for your id you are most likely going very near your firearm, even though you know your intentions are harmless, the officer does not. I don't ever want to get a call that one of my friends was shot in the line of duty because he sacrificed officer safety for some whiny little bitch.

lol who's flipping it now, i bet you nor anyone else you actually know has been a victim of police brutality! classic chicken little syndrome! hell i better not drive into work today because a truck driver might have road rage and get out and beat me with a tire iron :D

there's a difference between plain clothes detectives and that pos dorner. detectives are actual real cops acting in their official capacity, dorner was a former cop shit canned in 2008...

Maybe he is referring to this??
http://generalstrikeusa.wordpress.com/2 ... ll-ex-cop/

When you research the law in Maine are you searching concealed carry law or open carry law? I didn't think a permit was needed to open carry. I would think if someone were about to commit a crime they would be trying to hide the fact they are armed. If they saw a LEO headed for them they would run. Then again most criminals are not very smart.

FBI study has shown that most criminals go to great lengths to conceal their weapons. The same study also states that open carriers are generally law abiding citizens who will come to the aid of an LEO when needed.

nasty you keep bringing up different scenerios to try to validate your argument on being disarmed. google it. better yet stop by your local PD and ask them that way you will know for sure in your state. im sure you will be surprised.
i took my carry permit years ago and was told that i could be disarmed by a LEO during a stop of any kind. i let my certificate expire and just took the class again this past sat and was told the same thing for TN state law. he also went thru the book reading off states with the same legislature. (mostly southern border states. he didnt go through all of them)

Out of curiousity checked Virginia and this is the only law regarding open carry.

no, that's where you're wrong chummy, as long as the cop can articulate that it's for officer safety, he can pretty much do whatever the hell he wants.[/quote]

This is a problem^^^ can't just go around claiming safety for officers/ stepping on the people they are paid to protects rights. It happens yes. Bt this is a problem In my opinion in the justice depo. I'm not wrong in any way it's how I feel

These guys that are going out and doing this with video cameras are clearly just asking for problems, I don't understand it. They have the cameras because they KNOW there will be an issue..... Fucking stupid people. They are not going out and doing something that they would normally do and video taping it, they are going out there and saying "Hey look at me! My girlfriend doesn't spend enough time on my dick, so I'm trying to get attention!"

The people that pull these stunts on camera are dipsticks if someone is truly exercising their right to open carry they will be indiscreetly moving along minding their own business not standing on the side of the road causing a seen. While these guys are wasting these officers time there are real criminals out raping, killing, stealing, ect... and our tax dollars are paying this cop to star in some knuckle heads you tube video people who think these videos are cool are effing retarded
