 Coalition To Open Up Posted Waterways
Not sure how many have heard about the Louisiana Sportsmens Coalition. It started to reverse the trend to close off waterways as well as sections of lakes that are affected by tidal flow, calling them posted, private waters--that sort of thing. The law has stated and with precedent that if it is accessible by water and can float a toothpick, it is owned by the state as well as the wildlife that live in it, which means all of us. Well we need help. We need you to join and pay the money, only $20. This thing is actually moving fast with some legislators on our side. What is the law now? Do people own the waterways there? The only way you can own a piece of navigatable water is if your family still has the King's Grant. There are a few cases of this on at least 1 river here but the still cannot forbid you to pass through. You are not allowed to stop, fish or swim if they have it properly posted.
If you can get your boat in there by water you are allowed to just so you do not trespass on their physical property.

Boy I'm glad it isn't that way up here. If you can get a boat, canoe or skiff into it without touching dry ground you can pretty much hunt, fish or swim in it.

man, this will be nice. ALL of vermillion parish marsh will be public land. to hell with my duck deer lease, i'm going to hunt the tidal waterways on Rockefeller. i'm guessing marsh island will be public hunting too? if it's tidal and you can float in it, every marsh canal and ditch is now ready for any sport in a mudmotor to rape and pillage.
sounds good, but I seriously doubt the big money folks are gonna let the ordinary folks onto their high dollar properties. the 'landowners' who make tons of money off leases are not gonna like their cash cow getting shot. with open ditches thru a property you have zero control over what goes on.
can't wait to have 20 kayaks in my duck pond sight seeing on opening morning. lol hope they got ear plugs.

Personally, I'm all for it.
But....I doubt if this coalition will have the $$$ to fight Continental Land & Fur, Louisiana Land & Fur, Miami Land Corp, Biloxi Marsh Corp, etc.
In the end, campaign contributions to key sub-committee members gets decisions made in their favor.

Problem is... even if you have a ditch that runs through it... if the bird falls on the ground you either get a trespassing to hunt ticket or wanton waste ticket... that is the way it works here. You have to be careful when you are "buttholing" someone.

So what happens when you shoot a deer and it runs 100 yards onto someone else's property. They refuse to give you permission to retrieve the game. Do you get a wanton waste ticket then?

Legally you cannot trespass to retrieve game. I doubt you would get a ticket because most likely the game warden would not know about it. If you were hunting on the property line and your neighbor was asshurt about it and they called DNR everytime they saw you in the stand. I reckon that is when you could get a ticket because he could prove it was your deer. Folks are way less likely to get a ticket over a deer because it is not as in your face.

I'm against that. The bayou through my back yard is tidal, but I own that water. That canal was dredge after the property was purchased. It's just a bayou but how would you like it if someone was able to just camp out in your yard and you can't do shit about it ?

Kayak association has shown a lot of interest. SeaGrant is showing a lot of interest in this. Same with Bowfishing Association and many of the Fishing clubs. There are many writers looking to do stories on this. And there is some company that is wanting to do a documentary on the rights of access to the water that is deemed public, which is all flowing water.

Kids with mud motors will be tearing through every ditch in the marsh going to hunt tidal ponds. Not a good idea imo because of the ease if access with MMs.

Wow. So let me get this straight. If this law passes. I can go to the south end of big lake. Access Sabine refuge through weirs, then travel through lambert bayou towards gibbstown legally. If so then we going to have some pissed off people.

Yeap, I'm not for this. Sorry guys. I don't think this should pass at all. Honestly, the big companies that lease out all this land, will probably spend big money not allowing it to happen. I doubt this will pass. But you never know.

Actually there is no new law, it is existing law, that is not being enforced. Now there may be something to clarify the law. But Crawfisherman have already used the existing law for this. What we are being told is that the big companies are not spending any money on this but deferring to the people that hold the leases.
Why would big companies not spend their money to defend this? Maybe because they know they cannot win in a lawsuit. And the lease holders may not be wanting to spend the thousands to defend this
We will know more soon because of a case that is pending outcome next month. Sheriff's department water patrol issued tickets, when confronted in court to what law he used to issue a trespassing ticket, he could not quote one but said that in the lease, it said.......but leases are not the state of louisiana law. So when the actual law was read, the deputy was in the wrong, there was no trespassing on a flowing waterway.

I am not sure about if he will win his case or not. I know he has spent 50 times more money fighting the ticket, than if he would have just paid the ticket. The way he's telling me, it looks like he will win.
Also, if he does win and all this crap changes, I'm assuming tide water dock in golden meadow won't be able to have a guard snack on the water, only allowing boats with passes through? There will be tons and tons of pissed off people. Especially down here, it's very possible for someone to go missing if they continue messing with a mans property/lease. It won't be pretty at all.

Other then my situation your legal long as you dont step foot out of the boat into the water and your feet touch ground. I don't understand why but a private water way is private regardless, being that it was private regardless of the water level. On a river, marsh , lake etc long as you do t step out of the boat your legal.

Yes correct . Id like to fish everywhere I want, but I see both sides of the argument. People are making money leasing there marsh, etc for duck hunting. I don't think joe blow should be allowed to hunt there free while others pay . Keep in mind some of these marshes have cattle or livestock on that property . The current laws allows farmers to protect there live stock from idiots shooting them.

this issue is going nowhere, and the people starting all this mess will forever be known as a bunch of shit-starters who instead of going out and getting their own property to hunt/fish, they just tried to take over yours and mine. been going on for years, it's called communism and has never ended well.

At first thought I would be for this. Nothing pisses me off more than finding an nice 20' wide cut in the spillway to just fish and there is a freaking gate on it.
However, we have a slough running through our lease. That would suck if jackasses with their pretty lil surface drives could just joy ride.
